Terms of Service

The rules for using ManifestationAlarm.

Agreement

These terms are between you and ManifestationAlarm ("we", "us"). By creating an account or using the service you accept them. If you do not accept them, do not use the service.

Commitment Gifts are governed by the separate Commitment Gift Terms, which form part of this agreement and which you accept separately at the point of purchase.

What this service is

ManifestationAlarm helps you commit to daily actions and have another person verify that you did them. It is a tracking and accountability tool.

It is not medical, psychological, therapeutic, financial, or legal advice, and it is not a substitute for professional care. The reflective prompts in the app are a structured way to think about your own goals; they are not a clinical assessment and no clinical judgement is being made about you. If you are struggling with your mental health, please speak to a qualified professional.

We do not promise that using the service will achieve any particular outcome, including that you will complete a challenge or reach a goal.

Your account

You must be at least 18 years old. You are responsible for your account credentials and for everything done through your account. Tell us promptly if you believe it has been compromised.

One person, one account. Do not create an account for someone else or impersonate anyone.

Acceptable use

You agree not to:

  • Submit false evidence of completing an activity, or collude with a reviewer to have false evidence approved.
  • Use the service to harass, coerce, or pressure another person, including anyone you invite as an accountability partner.
  • Set challenges involving self-harm, illegal activity, or harm to others.
  • Attempt to access another user’s data, interfere with the service, or circumvent any limit or security control.
  • Use the service to launder money or to move funds under the appearance of a charitable donation.

Accountability partners

You choose who verifies your work, and they agree to do it. Both of you are responsible for dealing with each other honestly and civilly.

We do not supply, vet, train, or employ accountability partners, and we are not responsible for their conduct, availability, judgement, or the decisions they reach. Where a challenge has a Commitment Gift attached, the partner’s authority over the outcome and our limited power to review it are set out in the Commitment Gift Terms.

Subscriptions and trials

Some features require a paid plan. Where a free trial is offered, the length and what happens at the end of it are shown before you start it. Subscription charges recur until cancelled, and you can cancel at any time from Settings; cancellation stops future charges and does not refund the current period.

Commitment Gift purchases are separate one-off payments and are not part of any subscription.

Your content

Everything you write stays yours. You grant us only the licence we need to operate the service for you: to store your content, display it back to you, and show the specific parts described in the Privacy Policy to the people you have chosen to share a challenge with.

We do not use your challenge or reflective content to train models, and we do not sell it.

Availability

We aim to keep the service running but do not guarantee it will be uninterrupted or error-free. Reminders depend on your device, your network, and third-party notification services, and may be delayed or fail to arrive. Do not rely on a reminder as the only thing standing between you and an obligation that matters.

Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, or consequential loss, or for lost profits, lost opportunity, or lost data.

Our total liability to you for any claim arising out of or relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim arose, or one hundred US dollars.

Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud.

Suspension and termination

You can close your account at any time from Settings. We may suspend or close an account that breaches these terms, or where we are required to.

Closing an account does not cancel a Commitment Gift that has already been purchased; the outcome rules in the Commitment Gift Terms continue to apply to it.

Changes

We may update these terms. If a change materially affects your rights we will tell you before it takes effect. Continuing to use the service after that means you accept the updated terms. A change never applies retrospectively to a Commitment Gift already purchased — that gift stays governed by the version you accepted when you bought it.

Governing law

These terms are governed by the laws of the State of Washington, USA, and the courts of that jurisdiction have exclusive jurisdiction over any dispute. If you are a consumer, this does not deprive you of the protection of mandatory rules of law in your country of residence.
